7 Reasons to Use a Debt Negotiation Service:

First off, I should explain briefly what debt negotiation is.

Debt negotiation is the process of negotiating a reduced pay-off of a delinquent debt.

For example, let’s say you have a $5,000 credit card and you haven’t made a payment in over 5 months. You may be able to negotiate a reduced pay-off / settlement on this account for around $2-$3,000.

That is the basis of debt negotiation. This process can help you become debt free in a few months or years and could save you thousands maybe even tens of thousands of dollars off your debts over the course of time.

It is estimated that it would take the average consumer over 28 years to pay off $40,000 of delinquent debt if they were only paying the minimum payment at a 10% interest rate. Many consumers are paying upwards of 20-30% interest rates.

So debt negotiation is a great way to become debt free in a matter of months or years. Of course with any debt elimination solution, you always have the option to use a service or handle these matters on your own.

This is why I wanted to provide you with 7 Reasons to use a debt negotiation service. If you are interested in learning how to negotiate your own debts then you can easily go to www.byebyedebt.net and take a look at my do-it-yourself program.

7 REASONS TO USE A DEBT NEGOTIATION SERVICE:

REASON 1: Experience

Most of the major debt negotiation services that have been around for any length of time has years of experience in working with various creditors, collection agencies and collection attorneys and they know how to deal with your creditors / collectors to negotiate the lowest possible settlement – Meaning the more money you will save off your debts.

REASON 2: Protection of Your Rights

Most debt negotiation services are well versed and educated in the consumer laws that help protect your rights under state and federal laws which may prevent harassing or threatening calls.

REASON 3: Protection of Your Privacy

Most debt negotiation services will strive to help protect your privacy by not disclosing your private/confidential information to your creditors / collectors. Many consumers make the mistake of disclosing to much confidential and private information to their creditors which may help your creditors / collectors collect the money you owe.

By using a Debt Negotiation Service they can advise you on what information you should and shouldn’t disclose to your creditors to help protect your privacy. In fact most debt negotiation services should re-direct your creditor’s calls to their office to help insure your privacy is protected.

REASON 4: Reduce or Eliminate Harassing Collection Calls

Most debt negotiation services will notify your creditors & collection agencies that they are representing you and therefore will usually handle the calls and communication with your creditors/collectors. This in many cases can greatly reduce or eliminate the collection calls you would otherwise be receiving.

Many creditors and collectors will call you at home, at work, on your cell phone etc. Once again these are calls that the debt negotiation service you are working with could be handling.

REASON 5: Alleviate Undue Stress

Dealing with one’s debts can often times be both stressful and time consuming. By using a debt negotiation service, not only will you potentially save a substantial amount of money off of your debts, in many cases you won’t have to worry about the time and stress involved with trying to deal with your creditors and the harassing collectors that represent them.

REASON 6: Fees Structured on Savings

Most debt negotiation services will structure their fees based on a “Net Savings” meaning that you pay them a certain percentage of what they save you. This fee can and will usually very from company to company. For an example, let’s say that a company charges you 25% of the Net Savings and they save you $10,000 Off your debts. Your fee to them would be $2,500 ($10k x .25)

The great thing about this is that a debt negotiation service is going to strive to save you as much money as possible, because they earn their fees on the amount they save you. The more money they save you, the more they make. It’s a WIN-WIN situation.

REASON 7: Be Debt Free in 12-48 Months

Most debt negotiation services can tailor a program to help you become debt free in as little as 12-48 months, of course this will depend on your financial and total debt situation as well as the monthly payment you would be able to afford into a Debt Negotiation Program.

These are just a few of the many reasons that a consumer should consider using a Professional Debt Negotiation service such as National Debt Consultants, Inc. (NDC).

Of course this information is being provided for educational purposes and results may very.

Today is Friday, and I just received another great story from Bob Proctor daily quotes and stories. I’ll include a link in today’s blog. I have always been a huge believer in the Laws of Attraction, in fact I’ve spoken at a few seminars about The Law of Attraction and how it relates to an individual being in debt. Some of you may be scratching your head, while others may know exactly what I am talking about, so I’m going to briefly explain it and then I’ve copied and pasted today’s story from Bob Proctors daily stories.

The Law of Attraction, is simply you Attract what you think about or feel about in life Good or Bad. Now the basis of the law of attraction is simple, if you think about good things in your life, you will attract good “Positive” things over and over again. If you think about bad things in your life, you will attract bad “Negative” things over and over again.

Now of course, I deem myself the “Debt Elimination Guru”, so I want to give you my take on How the Law of Attraction works with consumers who have debt or “In Debt”. Having Debt or being in debt can sometimes be very stressful and can cause a LOT of Negativity in one’s life in regards to your employment and relationships. Most consumers don’t know where to turn or how to deal with their debts and financial situation and many times become overwhelmed by it all leading to more worry and fear.

These individuals have what I call the “In Debt Mentality” related to the stresses and fear involved with debt and in many cases, it is hard for them to see that their is light at the end of the tunnel and to focus on anything other then their debt and the problems surrounding debts. Because of this “The are Attracting” more debt into their lives, more negative thoughts and emotions. Remember you attract what you think about, therefore if you are thinking about debt and viewing everything about your debt as a negative, you are strengthening your thoughts, your beliefs and attracting more of the same into your life.

Right now, you may be “In Debt”, but one of the easiest ways to start becoming Debt Free is “Believe You Can Be Debt Free!” Use the Law of Attraction to your advantage by believing you can be debt free, you can make the money to help you easily pay off your debt, believe you will find a better job that pays more, believe that you will get the raise you want. Start thinking about positive thoughts in your life and shift your focus towards the things you want and desire and you will start to attract the positive things in your life as opposed to attracting the negatives or more debt. If you are saying that “This type of stuff doesn’t work” or “It won’t work for me” then guess what, it won’t.

The world and universe works in mysterious ways, you only have to find your connection to it and make it work for you and there is nothing you cannot do or achieve in your life, no matter who you are, what your upbringing was. You control your thoughts and your life. So make a decision to bring wealth, prosperity and abundance in your life and quit focusing on being in debt, start to focus on how it will feel to be debt free and start on a new path, a new journey.

Below is the story I received today by being on Bob Proctors mailing list. This is a great source for inspiration and I suggest that you sign up to receive daily quotes and stories today.

Wealth Comes In Many Forms

My mentor, Bob Proctor, once said, “Don’t cry over anything that won’t cry over you.” People will often create tremendous suffering for themselves just because they’re in debt or have lost money. They’ll generate intense feelings of anger, sadness, and fear, all of which are destructive and actually make it more difficult for them to regain the wealth they lost. Because they’re upset, they may fight with their spouse over money or become severely depressed, not realizing that the power to create abundance for themselves once again is always available to them.

When you understand that money is simply one form of the tremendous force known as abundance or wealth, and that you can always receive riches from our ever-giving Universe, it becomes easier to let go of negative feelings about money and the destructive belief that material wealth is more important than other manifestations of abundance. Ask yourself how much money you would take in exchange for your eyesight and your abundant health. How much would I have to pay you for you to give up your relationship with the person you love the most? My guess is that your health, your eyesight, and the people you love are far too precious to trade for any amount of money.

If what you receive isn’t money, open yourself up to it with gratitude and joy. Allow your creativity to flourish and you can discover ways to convert the abundance into the form you could most use right now.

Wisdom and knowledge are types of abundance that we often overlook. An antiques dealer I know often purchased items from homeless people who brought him furniture and other objects they’d found in the garbage.

He was always gracious and kind to them, and one day one of his regular sellers, who was a homeless man, noticed that the dealer had recently acquired a gold record by a celebrity.

“You have that underpriced,” he said. “I used to work in the music business. I know.”

The antiques dealer listened to what the man had to say and decided to take his advice and quadruple the price. A few days later, the dealer’s dentist came in, got very excited about the gold record, and said, “Listen, I’d love to own that, but I don’t have that much in cash to spend.

Everyday I receive calls from consumers who want to know “How to Deal With Harassing Bill Collectors and what Rights They Have?” So I’ve decided to pull some information from an ebook “27 Powerful Tips & Strategies to Stop Collector Harassment and deal with your creditors and collectors on your own terms!.

When I am working with one of my clients or even giving advice to a consumer who is looking for help or answers in dealing with bill collectors I advise them and reassure the consumer that “YOU Have Rights” in fact you have a lot of legal rights under state and federal law.

Even though it may not seem as though you do and your creditors and bill collectors that are contacting you may not make you feel as though you do, but “YOU Do Have Rights”

“You are Protected” by federal laws known as FDCPA “Fair Debt Collection Practice Act”. These are the set of Rules-Regulations-Laws that 3rd party collection agencies, debt purchasers, and collection attorneys have to adhere to.

Many credit card companies now abide by the same laws.

There are a whole set of rules that third party collectors have to adhere to.

Here are just a few of the rules that this law covers.

Collector cannot swear or be demeaning in any way.

Collectors cannot harass a consumer.

Collectors cannot call before 8:00 A.M. or after 9:00 P.M.

Collectors cannot call you at work if they know your employer bans such calls.

Collectors can not mention lawsuit, garnishment, levies etc. unless they have consent from their client and their next intent is to pursue further action.

These laws help protect you from Obscene, Profane, or Abusive phone calls.

These laws help protect you from Unscrupulous Collection Activity.

If you feel that your rights have been violated, you have the right to sue the collector and the company they work for, up to $1,000 per violation.

Keep in mine; it’s your word against theirs, so you should have full documentation of your correspondence and communication with bill collectors to prove your case. In fact, I would even recommend you record calls, if you have the capability to do so from your phone or computer. I believe there are a few great programs out there to do so, such as vonage or skype. You can do a google search to find out more information about these services. Of course, you will want to look into state or federal recording laws. A majority of states have what is called a “one-party consent” statute, which means as long as you are a party to the conversation, it is legal for you to record the call without making the other party aware.

Having a recording of a bill collectors harassment is very powerful and can be used in your efforts in trying to deal with bill collectors as well as sueing them for violations of your rights. I was recently watching a news cast where a collector threatened a consumer multiple times and the consumer recorded the calls. The consumer ended up retaining an attorney and sued the collection agency. The consumer was awarded $222,0000 – Yes, your eyes are not deceiving you $222,000. So, recording bill collectors harassment can definitely pay.

I’m not saying that everyone would have a payday like that, but you may be able to sue a collector or collection agency for a $1000 per violation as mentioned before.

Of course, I can’t disclose all my inside knowledge and secrets so I won’t tell you how to sue a collection agency or bill collector. If you are looking for powerful information to dealing with your debts, creditors and collectors watch for our “NEW Membership” site that will be opening up towards the end of the month.

If you feel that your rights have been violated you can file a formal complaint with the Attorney General in your state or with the “Federal Trade Commission”. As mentioend before you can sue a collection agency and most consumers can generally handle this by yourself with the right knowledge and experience, or you could choose to use a reputable attorney or law firm (of course this may be costly).

So just remember, You Do Have Rights, even though most bill collectors will tell you “You Don’t” only to try and scare, manipulate you into paying your bill.

If you are looking for more extensive information on the Fair Debt Collection Practice act you can obtain information by going to the Federal Trade Commissions website at www.ftc.gov.

Yes, I said it, Suze Orman is wrong on soooooooooooo many levels. I’ve been meaning to write a blog about Suze Orman for quite some time. Here you have a women that has her own television show backed by a major network and lining her pockets with money she earns by her partnership/affiliation with all the major creditor bureaus, making a Fortune off of telling everyone they need to cut back on their spending etc. If you’ve ever watched Suze Orman’s show, you would know exactly what I was talking about, if you haven’t don’t waste your time, unless you want someone to preach to you about not living outside of your means (which is good advice that anyone can tell you) or she advises you to cut back on everything in your life. I believe that consumer’s should explore different opportunities to Make More Money in their lives rather then focusing on cutting back. Come on people this is america, the land of opportunity, there are a million and one ways to make money out there. Just look at Suze Orman, here is a woman telling YOU to cut back on your spending and not buy what you want, while she sits back and makes millions off of her information products and television show, do you think she is cutting back, NO, in fact she is thinking of the next idea to make even more money.

I’m not saying go out and spend your children’s college tuition or blow your weekly paycheck on frivolous stuff you don’t need or even go out and start a business without looking into it first. What I am saying is temporarily cut back on some of your spending while you are working on making more money in your life, and focus on Abundance, making more money, rather then on not having enough money.

Don’t get me wrong, I’ve never met Suze Orman, and I’m sure she is a great (Rich) lady and she does help some consumers, but I would much rather help someone by showing them there are ways to make additional money in one’s life, rather then telling someone they have to cut back on everything or almost belittle them or cut them down for their habits.

Do yourself a favor and make a decision in your life to make more money and focus on that -even if you have to “Temporarily” cut back on spending, know it is for a better future for yourself and/or your family.

You are in control of your own destiny, your own life, your own financial future, but you have to make a decision and desire a better life. Focus on the money you want and the things you want in life and eventually you will have them, everything begins with what you believe in. If you believe that you are stuck at a job and that you are only able to make so much money, then chances are, you are right. So if this is your belief of things, then change your belief and you could change your life.

How to STOP Collection Calls & Harassment: Part 2

How to STOP Collector Calls & Harassment – Part 2:
In my last blog posting, I discussed how you can Reduce or Eliminate Collection Calls by advising a bill collector to “Cease & Desist” collection calls. In this blog posting, I am going to give you another Powerful Tip in dealing with bill collectors on your own terms to help protect your rights under the FDCPA (Fair Debt Collection Practice Act).

Well here it is, short-sweet-and simple. When you receive a call from a debt collector advise them of the following: “Please be advised, that I may record this call or any future calls I receive from your collection agency!”

You may want to say this word for word to the bill collector that is calling you. This is a sure fire way to keep debt collectors in check so they aren’t saying something that may be illegal or against your rights.

Now you don’t necessarily have to record the call, you only simply have to make this “POWERFUL” statement and the collector is going to be on guard, in fact you may even discover that the bill collector hangs up you.

If they try to argue with you about you being able to record their conversation, simply restate the above line again, and because you are putting them on notice, you have the right to record any call as long as you notify the other party that you intend to record the call. In some states you don’t even have to notify the other party, but that will vary from state to state and something that I just don’t have time to cover.

If you want to record calls you should check with your local electronic store to see what sort of inexpensive devices they have for you to record telephone calls. There are also great programs that will run through your computer, simply enter into google the following: “Telephone Recording Software” and you are bound to find some great programs.

Don’t let bill collectors try to scare you or manipulate you into believing that you don’t have rights, because you do……….bill collectors are sometimes predators and are looking to prey upon consumers that don’t know their rights. So do yourself a favor and keep reading my blogs or share this information with your friends, family members and business associates.

Sincerely,
Jason Oswald

How to STOP Collection Calls! Part 1

How to STOP Collection Calls, is one of the easiest things a consumer can do. There are a few different ways to go about stopping collection calls that all evolve around, what is called a “Cease & Desist” notice. A “Cease & Desist” is simply a verbal or writtent statement that you want any/all calls and/or communication to STOP……..you are telling someone (preferably harassing bill collectors) that you want them to Cease calling you.

There are going to be different situations in dealing with debt collectors where you only have to advise them that you want them to “Cease & Desist”. These situations are as follows:

Place of Employment (work):
If you tell a bill collector that you cannot receive calls at work because it is an inconvenience for you or your company or boss does not allow it, then a verbal “Cease & Desist” is enough under the FDCPA (Fair Debt Collections Practice Act) – Just to be on the safe side, I would recommend you fax over a “Cease & Desist” letter.

You should also ask the collector to remove your work number from their system and advise them that if you receive another call at work, you will consider it a violation of your rights under the FDCPA and may pursue legal action against them.

Cell Phone:
A collection agency cannot make a consumer incur any type of expense while they are trying to collect a debt from the consumer. In most cases consumers pay for minutes or a monthly plan on their cell phones. With this in mind, if a bill collector is calling you on your cell phone, they are making you incur an unecessary expense, so as I mentioned above, a verbal “Cease & Desist” should suffice. Simply advise the collector that they are calling your cell phone and that it is costing you money and that you want them to “Cease & Desist” from calling your cell phone.

Keep in mind most bill collectors will try to get other numbers from you if they take out a work or cell phone number, if you want to give them a new number -then that is your choice.

What I would recommend is that you request that they put everything in writing, rather then provide them with a phone number they may not have.

As mentioned before, the examples I just conveyed is where a “Verbal Cease & Desist” is only necessary, now if you want to STOP the collection calls at home, you will have to send that request in writing. Meaning that you send a letter to the collection agency or creditor requesting them to “Cease & Desist” Telephone communication with you.

I would recommend that you send such a letter via certified mail, that way you have proof that you sent it.

Tip: If you are requesting your creditors or bill collectors to “Cease & Desist”, you will want to make sure you ONLY request them to “Cease & Desist” telephone communication. You do not want to shut down all lines of communication your creditors or collectors may have, such as snail mail. This has ended a lot of consumers in a position where they are sued, because the creditor or collection agency was “Ceased & Desist” from all communication………………so once again, only request the cease & desist on telephone communication………………this should STOP the harassing Collection Calls.

There may be more information not conveyed here, but this should give you a general idea of what you need to do, to Stop the Calls!

If you would like a “Powerful Cease & Desist” Letter, contact me via this posting.

“DON’T BE AFRAID OF BILL COLLECTORS”

All to often in my line of work I receive calls from worried consumers who are afraid of harassing bill collectors that are trying to manipulate them or scare them into paying their debts. That’s all it is, plain and simple, these collectors are trying to coerce you into paying your debt and they will say or do whatever it takes to get you to pay, yes, even if it stems on the verge of being illegal.

I am here to tell you DON’T BE AFRAID of your creditors or bill collectors and definitely don’t be afraid to talk to them. They have a job to do and they are only trying to collect as much money as possible from you as quickly as possible and if you tak my advice and read my blogs you will find some great information to deal with them on your own terms.

Bill collectors can’t reach through the phone and into your wallet and they can’t squeeze blood out of a turnip, they may threaten different action against you and they may be ruthless in their efforts, but this is no reason to cause concern or alarm, because you have legal rights under the Fair Debt Collection Practice act, check out my previous blogs to help protect you from having bill collectors say something that may be illegal.

All a collector has are their cut-throat collection tactics to either try to work with you, or try to scare you into paying your bill.

They aren’t men in black suits that will come and take you away.
They are not the local mob that will break your arm if you don’t pay.

All they have is psychological warfare to try to coerce you into paying your bill.

They can’t climb through the phone and reach into your wallet, or twist your arm to write them a check.

They may be an hourly paid employee sitting behind a desk to try to intimidate or scare you that your account will be sent out for collections Or they may be a commissioned collector that is trying to scare you into paying a debt so they can earn more commissions.

Sure there are certain things that could occur if you continue to ditch and dodge bill collectors, and the worse that could happen is that you are sued and a judgment is entered against you. Once a judgment is entered against you, they may be able to garnish your wages, take out a lien against personal property or levy your checking account…………this my friends is the worse case scenario, and is highly unlikely to occur if you are taking a pro-active approach in attempting to deal with bill collectors and your creditors.

In many cases with a bill collector threatens these types of actions against you, they are lying to you and you should call them out to test whether or not what they say is true. Ask them the following questions if they mention any of the above:

Has your client authorized you to sue me?
Who is the attorney that will be representing your client?
When will you be sending a court summons or a discovery questionaire?
Are you threatening to sue me, if so, is this your last call to advise me of my rights?

There are multiple questions you can ask, but ask one or two questions to put the bill collector on the spot and let them know you are educated. People this works, it helps keep bill collectors in check………….once again, don’t be afraid of bill collectors, mostly what they have to say is idle threats……….a creditor doesn’t always want to take legal action against a consumer and they would rather have a collection agency try to collect on a debt for a months even years, before pursuing that course of action, but it is a possibility.

Even if a judgment is entered against you, you can always negotiate a reduced pay-off (settlement) of your debt……and maybe save thousands through debt negotiation.

Debt Elimination Options: Debt Negotiation

Consumers have multiple Debt Elimination Options and one of the quickest and easiest option is Debt Negotiation. I want to give you a little bit of background of what debt negotiation is, how it works and who it can help.

What is Debt Negotiation?
Debt Negotiation is a process of negotiating a reduced pay-off also known as a settlement of one’s DELINQUENT DEBT. A consumer can usually save between 30-80% OFF their delinquent debt, if they know how to properly negotiate their debts, because believe me there is a right way and there is a wrong way. I’m not going to go into great detail about this, but if you are interested in learning how to “Successfully Negotiate Your Debts” then go to our website at www.nationaldc.com.

As you may have noticed I put emphasis on the fact that your debts must be delinquent when attempting to negotiate your debts. The reason for this, is that most credit card companies are not going to agree to debt settlement if you are making your monthly payments, why would they?

Your debts will need to be at least 90 Days delinquent before most creditors will even discuss the possibility of a settlement. It seems the more delinquent your debt is, the greater the savings you can negotiate off your debts.

Don’t get me wrong, I’m not saying purposely go delinquent on your debts to force your creditors into agreeing to a settlement on your debt, but if you are in a situation where you can’t afford to keep up with your payments; then you may consider this being a future option when your debts become delinquent.

Debt Negotiation is the #1 Bankruptcy Alternative for many individuals and should definitely be considered as a powerful alternative to filing a bankruptcy, but everyone’s situation is different so you should always explore your options.

Debt Negotiation Can Save You Thousands:
One of the great things about negotiating your delinquent debts, is that you may be able to take care of your debts for pennies on the dollars. Imagine this scenario, you have $40,000 in credit card debt and you are able to successfully negotiate this debt down to $15,000 with a little bit of effort and time. Meaning you would have SAVED around $25,000 OFF Your Debts………Do you think this is worth your time to learn how to successfully negotiate your own debts? I would hope so……………..remember you can request information about our Exclusive Do-It-Yourself Program by emailing me at jason@nationaldc.com

Debt negotiation helps you take care of more of your debts for less. Consumers that have access to a large sum of money to negotiate with, may be able to become debt free in a matter of months as opposed to years.

Debt Negotiation Can Work for Anyone:
Debt negotiation will work for anyone regardless if you have access to a large sum of money for purposes of settling your debts or whether you are able to set money aside each and every month. If you have some type of income coming in, debt negotiation should work for you.

Credit Concerns:
When considering the option of debt negotiation, one should consider the fact that anytime they become delinquent on a debt, it may have a negative impact on your credit. If credit is a concern of yours then you may want to find a way to bring your accounts current and maintain your monthly payment with your creditors.

One question I ask my clients is “Are you concerned about your Credit or Becoming Debt Free?” Only you can answer this question for yourself, but remember when attempting to negotiate your debts, in many cases your debts will have to be at least 90 Days Delinquent before a creditor would even consider discussing a settlement.

Right Way & Wrong Way:
As mentioned previously there is a right way and there is a wrong way to go about attempting to negotiate your debts. Many times individuals will jump online and get tid bits of information and think they know how to negotiate their debts and then once they contact their creditors or collection agency, they end up saying or doing the wrong thing and lose all negotiation leverage.

Dealing with bill collectors and attempting to negotiate a settlement on your debts isn’t hard once you know “What to Say” and “What Not to Say” to your creditors or bill collectors to maximize your Savings Results. Saying the wrong thing could cost you thousands of dollars in potential savings, so don’t you think it would make sense to learn the proper techniques and strategies before attempting to negotiate your own debts.

Who better to learn from then an individual or company that does this everyday. If you are interested in learning how to successfully negotiate your own debts, keep reading my blog or contact me directly at jason@nationaldc.com.

Disclaimer: This information is for educational purposes only and results will vary. This information should not be considered legal advice. If you feel you need legal advice you should consult a reputable attorney in your area.
